KrakenD Training Terms and Conditions

These Terms and Conditions (“Training Terms”) govern your access to and use of the KrakenD Training platform, courses, certifications, and related educational content (collectively, the “Training Services”). By accessing or using the Training Services, you agree to be bound by these Training Terms.

These Training Terms are supplementary to and should be read in conjunction with the Terms and Conditions, Privacy Policy, and Cookies Policy of the KrakenD website. In case of conflict between these Training Terms and the general Terms and Conditions, these Training Terms shall prevail with respect to the Training Services.

1. Definitions

1.1 “Course” means any educational content, including video lessons, text materials, quizzes, assessments, and code examples made available through the Training Platform.

1.2 “Training Platform” means the online learning environment hosted at training.krakend.io, powered by Thinkific.

1.3 “Student” or “You” means any individual who registers for or accesses the Training Services.

1.4 “Content” means all materials provided as part of the Training Services, including but not limited to video recordings, written tutorials, code samples, quizzes, assessments, and any other educational materials.

1.5 “Certification” means the official credential issued by KrakenD upon successful completion of a Course and its associated assessments.

1.6 “Free Content” means any Course content or materials made available without payment.

1.7 “Paid Content” means any Course content or materials that require payment to access.

2. Acceptance of Terms

2.1 By creating an account on the Training Platform, enrolling in a Course, or accessing any Content, you acknowledge that you have read, understood, and agree to be bound by these Training Terms.

2.2 If you are enrolling on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Training Terms.

2.3 You must be at least 18 years of age to use the Training Services. By using the Training Services, you represent and warrant that you meet this age requirement.

3. Account Registration

3.1 To access the Training Services, you must create an account on the Training Platform. You agree to provide accurate, current, and complete information during registration.

3.2 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.3 You must notify KrakenD immediately of any unauthorized use of your account or any other security breach by contacting [email protected].

3.4 KrakenD reserves the right to suspend or terminate your account if any information provided proves to be inaccurate, false, or incomplete.

4. Access and Use of Content

4.1 License Grant

Subject to your compliance with these Training Terms and payment of applicable fees, KrakenD grants you a personal, non-exclusive, non-transferable, revocable license to access and use the Content solely for your own educational and professional development purposes.

4.2 Access Duration

Access to the Content is provided on an indefinite basis while the Training Services remain active. KrakenD reserves the right to:

• (a) Update, modify, or replace the Content at any time to improve quality or reflect changes in the KrakenD software;
• (b) Discontinue the Training Services with a minimum of ninety (90) days prior notice to registered Students;
• (c) Migrate the Content to a different platform while maintaining access for existing Students.

4.3 Restrictions

You may not:

• (a) Share, transfer, or sell your account access to any third party;
• (b) Download, copy, reproduce, or redistribute any Content except as explicitly permitted;
• (c) Record, capture, or create derivative works from video content;
• (d) Use automated tools to access, scrape, or download Content;
• (e) Remove or alter any copyright notices, watermarks, or proprietary markings;
• (f) Use the Content to create competing educational materials or services.

4.4 Code Samples

Code samples and examples provided within the Courses are licensed for your personal and professional use in your own projects. You may incorporate these code samples into your applications, subject to any specific licensing terms indicated within the Course materials. This license does not extend to redistributing the code samples as standalone educational materials.

5. Course Content and Updates

5.1 KrakenD strives to provide accurate, current, and comprehensive educational content. However, due to the evolving nature of technology, some Content may become outdated between updates.

5.2 KrakenD reserves the right to update, modify, or remove any Content at any time without prior notice. When significant changes are made, we will endeavor to notify enrolled Students.

5.3 The Training Services are provided for educational purposes. While we aim to provide accurate information, KrakenD does not guarantee that the Content will meet all of your specific professional requirements or that following the Course will result in any particular professional outcome.

6. Certifications

6.1 Earning Certification

To obtain a KrakenD Certification, you must:

• (a) Complete all required Course modules and lessons;
• (b) Pass all required assessments with the minimum score specified in the Course;
• (c) Comply with all applicable Training Terms and conduct requirements.

6.2 Certification Validity

Certifications are issued to the individual Student and represent that the Student has successfully completed the specified Course requirements at the time of issuance. Certifications do not expire unless explicitly stated otherwise.

6.3 Use of Certification

You may:

• (a) Display your Certification credential on your resume, portfolio, or professional profiles;
• (b) Share verification links provided by the Training Platform;
• (c) Use any digital badges associated with your Certification on professional networks.

6.4 Revocation

KrakenD reserves the right to revoke any Certification if:

• (a) The Certification was obtained through fraud, cheating, or misrepresentation;
• (b) You violated these Training Terms in obtaining the Certification;
• (c) You are found to have shared exam answers or assessment content with others.

In such cases, you will be notified and given an opportunity to respond before any revocation takes effect.

7. Payments and Refunds

7.1 Pricing

Prices for Paid Content are displayed on the Training Platform and are subject to change. All prices are exclusive of applicable taxes unless otherwise stated.

7.2 Payment Processing

Payments are processed through the Training Platform (Thinkific) and its payment providers (including Stripe). By making a purchase, you agree to the payment terms of these providers.

7.3 Refund Policy

• (a) You may request a refund within fourteen (14) days of purchase if you have not completed more than twenty percent (20%) of the Course content.
• (b) Refund requests must be submitted to [email protected] with your order details.
• (c) Refunds will be processed using the original payment method within fourteen (14) business days of approval.
• (d) Certifications obtained before a refund is requested will be revoked upon refund.

7.4 Taxes

You are responsible for any applicable taxes associated with your purchase. KrakenD will collect and remit taxes where required by law.

8. Intellectual Property

8.1 All Content, including but not limited to videos, text, graphics, code samples, quizzes, and Certifications, is the exclusive property of KrakenD or its licensors and is protected by copyright, trademark, and other intellectual property laws.

8.2 The KrakenD name, logo, and all related marks are trademarks of KrakenD. You may not use these marks without prior written permission except as explicitly permitted for Certification holders.

9. Student Conduct

9.1 You agree to:

• (a) Use the Training Services only for lawful purposes and in accordance with these Training Terms;
• (b) Complete all assessments and evaluations honestly and independently;
• (c) Respect other Students and KrakenD staff in any community features or communications;
• (d) Report any bugs, security issues, or concerns to [email protected].

9.2 You agree not to:

• (a) Share your account credentials with others;
• (b) Share quiz answers, exam questions, or assessment content;
• (c) Use the Training Services to harass, abuse, or harm others;
• (d) Attempt to gain unauthorized access to any part of the Training Platform;
• (e) Interfere with or disrupt the Training Services or servers.

9.3 Violations of these conduct requirements may result in suspension or termination of your account, revocation of Certifications, and prohibition from future use of the Training Services.

10. Third-Party Platform (Thinkific)

10.1 The Training Platform is hosted by Thinkific Labs Inc. (“Thinkific”). By using the Training Services, you acknowledge that your use is also subject to Thinkific’s Terms of Service and Privacy Policy.

10.2 KrakenD is not responsible for:

• (a) Technical issues, outages, or service interruptions caused by Thinkific;
• (b) Changes to Thinkific’s services that may affect the Training Platform;
• (c) Data processing conducted by Thinkific in accordance with their own policies.

10.3 For information about cookies and tracking on the Training Platform, please refer to Thinkific’s Cookie Policy in addition to KrakenD’s Cookies Policy.

11. Limitation of Liability

11.1 The Training Services are provided for educational purposes only. KrakenD makes no guarantees regarding:

• (a) Your ability to obtain employment or professional advancement;
• (b) The applicability of the Content to your specific use case;
• (c) Uninterrupted or error-free access to the Training Platform.

11.2 To the maximum extent permitted by applicable law, KrakenD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Training Services.

11.3 KrakenD’s total liability for any claims arising from or related to these Training Terms or the Training Services shall not exceed the amount paid by you for the specific Course giving rise to the claim.

11.4 Nothing in these Training Terms excludes or limits KrakenD’s liability for matters that cannot be excluded or limited by applicable law, including fraud or gross negligence.

12. Data Protection

12.1 KrakenD processes personal data in accordance with our Privacy Policy, which includes specific provisions for the Training Services.

12.2 When you use the Training Platform, the following additional data may be collected and processed:

13. Modifications to Terms

13.1 KrakenD may modify these Training Terms at any time. We will notify registered Students of material changes by email and/or by posting a notice on the Training Platform.

13.2 Changes will become effective thirty (30) days after notification unless otherwise specified. Your continued use of the Training Services after changes become effective constitutes acceptance of the modified Training Terms.

13.3 If you do not agree with the modified Training Terms, you may discontinue using the Training Services. Refund rights for paid courses will be evaluated on a case-by-case basis.

14. Termination

14.1 You may terminate your account at any time by contacting [email protected]. Termination does not entitle you to a refund for any fees paid.

14.2 KrakenD may suspend or terminate your access to the Training Services at any time for violation of these Training Terms or for any other reason at KrakenD’s discretion, with or without notice.

14.3 Upon termination, your right to access the Content will cease immediately. Certifications legitimately earned prior to termination will remain valid unless revoked for cause under Section 6.4.

15. Governing Law and Jurisdiction

15.1 These Training Terms are governed by and construed in accordance with Spanish law.

15.2 Any disputes arising from or in connection with these Training Terms shall be submitted to the exclusive jurisdiction of the Courts of Barcelona, Spain, with express waiver of any other jurisdiction that may apply.

15.3 If any provision of these Training Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
